Evan was called to the Bar of England & Wales in 2015 and the Malaysian Bar in 2016. He read law at the University of Reading and was trained as a barrister in Prifysgol Caerdydd. He also holds a professional diploma in International Arbitration and is a member of the Malaysian Institute of Arbitrators and the Medico-Legal Society of Malaysia. He has conducted trials and hearings in the High Court and Subordinate Courts and appeared as counsel in the appellate courts.
Evan’s primary area of practice is dispute resolution. He primarily advises on disputes arising from medical malpractice & professional misconduct and appears as counsel for patients and healthcare providers to resolve medicolegal disputes in Court and the Malaysian Medical Council and Malaysian Dental Council.
Evan’s work includes interaction between various disciplines of medicine and law and presenting expert evidence in proceedings. He has acted in cases involving anaesthesiology, cardiology, cardiothoracic surgery, colorectal surgery, dentistry, dermatology, ear nose and throat (ENT), emergency medicine, gastroenterology, general surgery, neonatology, nephrology, neurology, obstetrics & gynaecology, oncology, ophthalmology, oral & maxillofacial surgery, orthopaedics, paediatrics, plastic surgery, psychiatry, rehabilitation medicine, radiology, rheumatology, urology, urogynaecology, vascular surgery, traditional & complementary medicine and etc.

For claims arising in Peninsula Malaysia & the Federal Territory of Labuan (Excluding Sabah & Sarawak):
1. 6 years in cases involving private healthcare institutions;
2. 3 years for cases involving public healthcare institutions;
3. For minors or patients of unsound mind, the relevant limitation periods will commence upon cessation of such disability; and
4. 3 years from the date of death for claims involving deceased patients.
How to prove medical negligence in Malaysia?
Medical negligence is proven when the Court is satisfied that the defendant’s actions had fallen below the standard of care expected of him and was the operative cause of the patient suffering injury, loss or damage.
